These Terms of Service (“Terms”) govern your access to and use of Whitrack (the “Service”), operated by Whitrack, Inc. By signing up for an account or using the Service, you agree to these Terms.
1. Your account
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and authorized to bind your business to these Terms.
2. Acceptable use
You agree not to:
- Use the Service to send spam, unsolicited messages, or unlawful content
- Violate telecommunications laws (TCPA, CAN-SPAM, applicable local rules)
- Attempt to reverse engineer, resell, or abuse the Service
- Upload customer data you are not authorized to process
3. Subscriptions and billing
Paid plans are billed monthly in advance. You may cancel at any time; your access continues through the end of the current billing period. Trials are free for 14 days with no card required. We do not offer prorated refunds for partial months.
4. Messaging and AI
The Service sends SMS, MMS, and WhatsApp messages to phone numbers you or your customers provide. You represent that you have the legal right and prior consent to contact those numbers. Whitrack may use AI models to draft, summarize, or respond to messages on your behalf; you remain responsible for the content that is ultimately sent.
5. Data ownership
You own your customer data. We process it on your behalf to provide the Service. See our Privacy Policy and Data Processing Addendum for details.
6. Termination
We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail payment. You may export your data at any time from your account settings; after termination we retain backups for 30 days then delete them.
7. Disclaimers and limitation of liability
The Service is provided “as is.” To the maximum extent permitted by law, Whitrack's aggregate liability under these Terms is limited to the amount you paid in the 12 months preceding the claim.
8. Changes
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before they take effect.
